New Construction in DFW: Four Questions to Ask About Inspections and Deposits

By Clarissa Jackson, REALTOR®, Orchard Brokerage · · 6 min read

The short answer

Before you sign a new-construction contract in DFW, ask four questions: How can my deposit be returned if the home is not yet built? Can I use a lender other than the builder's preferred lender? Will independent inspections be allowed, and when? How will repair requests be handled? Your actual rights depend on the contract you sign, so get these answers in writing first.

A model home can make everything feel simple. The contract is where the details live, and builder contracts are often written by the builder. A few clear questions up front can save you from surprises later.

If you’re looking at new construction around DFW, let’s talk through your plan before you choose a home.

1. How can my deposit be returned?

The CFPB suggests buyers of a home that is not yet built ask how a deposit can be returned. Do not assume a deposit is automatically refundable. Ask what situations, if any, allow a refund, what deadlines apply and where that is written in the contract.

2. Can I shop for a different lender?

Builders may promote a preferred lender, sometimes alongside incentives. The CFPB notes you may shop for a different lender. Compare loan estimates side by side so you can see whether an incentive tied to one lender is the better overall deal for you.

3. Are independent inspections allowed?

Not every builder handles inspections the same way. Ask whether you may hire your own inspector, at which construction stages and with what access rules. The CFPB also suggests considering financing and inspection contingencies; whether they are available depends on the contract.

4. How are repair requests handled?

Ask how items found during inspections or the final walk-through are documented, who decides what gets fixed, and the expected timeline. Also ask how warranty requests work after closing.

Frequently asked questions

Is a builder deposit refundable?

Not automatically. Whether and how a deposit can be returned depends on the contract you sign, so ask before signing and get the answer in writing.

Do I have to use the builder's lender?

The CFPB notes you may shop for a different lender. An incentive may be tied to a preferred lender, so compare the full loan estimates.

Can I get an independent inspection on new construction?

Many buyers ask for one, but builder rules vary. Ask whether independent inspections are allowed, when, and under what conditions.

Should I ask about contingencies?

The CFPB suggests considering financing and inspection contingencies. Whether they are included depends on the contract.

What happens if an inspection finds problems?

Ask how repair requests are documented and handled before you sign. The process depends on the builder and the contract.
